Considering Wall Street is having it's best year in so many years, in light of so many "regular U.S. folks" unemployed and struggling to make ends meet, doesn't that say to YOU, that us regular people in America don't really mean much to the GLOBAL economy? (Yeah, the mass of Americans are in the toilet, but the world and White House keeps pumpin' along at record levels. (YOU'VE BEEN DEVALUED, SOLD-OUT AND THROWN UNDER THE BUS BY THE PEOPLE ELECTED TO REPRESENT...YOU! (Ooops, guess YOU are not on the global stock market ticker. GO "F" YOURSELF!)

WONDER WHAT I THINK @ $1500?: When I screamed BUY GOLD @ $850, I was told, "overvalued." Continued screaming on blog thru $1200. LUCKILY, I DID urge a relative to buy at $950; and helpful friend at $1100. (A tough sell at that price, but ZD can be VERY PERSUASIVE when he is certain of something to happen in the future.) So do you wonder what I think about the price of GOLD, today, in $1500 range. (I HOPE you do!)

ZUMA DOGG PUBLIC COMMENT from today's 11/02/10 Council Meeting (Plus some from last meeting at the end of the first two new comments.)


Today, the Los Angeles CAO department was at the council meeting to talk about the budgetary crisis. ZD had to leave and will watch it on the TV 35 playback, tonight, but I spoke with insiders in the office and said, "should i STILL be going with the 'headed for bankruptcy' -- all hell breaks loose, worst ever scenario...or have things improved...maybe not as bad as I'm saying..." 

CAO insider says, "no, no...you're still on message...it's REAL BAD (can't contain nervous smile)...

I ask, how long until we feel next wave of PAIN? They said, In the next 2 months." 

I asked, "What? More library closings...or maybe even some OTHER things (tongue in cheek)."

They said, 'gonna be a lot of tough choices."

 MEANWHILE: Ron Kaye says he was kicking and screaming at the TV today, during the discussion...so he has finally caught up with Zuma Dogg on that department. (Luckily, I keep finding new (used) TVs on the street alleys of Venice to replace the old ones.) 

BUT, the point was to let you know...if Ron's at point of screaming back at the TV...it couldn't have been a very satisfactory discussion at Council today regarding budgetary matters.

1st AMENDMENT in COUNCIL CHAMBERS UPDATE: For the second meeting in a row, Zuma Dogg spoke for entire two minutes at a time (the length of the public comment time, per item) WITHOUT BEING INTERRUPTED! As you know, not only is Dowd/Dogg waiting for the Federal Judge to eventually rule on the "Code of Conduct" portion of the lawsuit, which he already placed an injunction on a part of (over the Venice Beach portion); so perhaps they see which way this Federal wind is blowing -- and are simply choosing to begin conducting the meetings in the true spirit of the 1st Amendment of the U.S Constitution. 

FEELS GOOD..and I know it's a little bit uncomfortable for Garcetti or Zine to have ZD blasting stuff like talk of the Bloomberg news article on FBI investigations into L.A. City affordable housing projects...but that's what the small "d" democratic process is about. 

So ZD isn't gonna take advantage of it, and start to try and push it by yelling a little louder -- or try to take a little more liberties with the "on topic" rule. (Because I know once I start doing that, they WILL have to sit up and interrupt.) So hopefully, we've struck the right balance as allowed by their code of conduct (cause ZD wants to go MUCH further than council allows...FOR NOW)...BUT, it's MORE UNCOMFORTABLE than Council would prefer. 

So I GUESS EVERYBODY'S HAPPY...IF NOBODY'S HAPPY (all the way)!

You are free to do what you want to do on the Venice boardwalk, a federal judge ruled this week. Local activist Zuma Dogg, who brought the case against the city's lottery system of distributing permits to performers and vendors, was victorious.

He told the Weekly Wednesday afternoon that it was likely he would bring a civil suit against the city for allegedly violating his free speech on the boardwalk.

"The city of Los Angeles was arrogant," he said at an meeting on the matter Wednesday morning captured on video. "The city failed ... My damages will be millions."



The city can't establish such a permit system regarding who can and can't sell trinkets and sing songs on the iconic boardwalk because it violates the right to free speech, U.S. District Judge Dean Pragerson ruled.

Permits should be first-come, first-serve, and amplified sound and instruments should be allowed in some areas between 9 a.m. and sunset, he said.

"I'm very happy that the federal judge saw it our way," Zuma Dogg told the Weekly. "It's unfortunate It came to this after all these years, with lives destroyed."

He's frustrated because he says he warned the city to improve the system before a judge stepped in.

"For years they had a chance to settle," Zuma Dogg says. "The city had years in which a federal judge was asking them to be reasonable."

10.27.10 LOS ANGELES — A federal judge has struck down city regulations  governing who gets to sing and sell along crowded Venice Beach in Los  Angeles.

U.S. District Judge Dean Pragerson ruled last week that the city's  weekly lottery system for distributing permits to boardwalk vendors and  performers during the summer season violates the First Amendment.

Pragerson issued a temporary injunction, saying the city should issue permits on a first-come-first-served basis.

The judge also struck down a rule barring amplified sound and musical instruments between 9 a.m. and sunset in certain areas.

The city's 2008 ordinance, which was revised last year, was contested by 13 performers.
Plaintiff and street performer "Zuma Dogg" told the Los Angeles Times yesterday that the city should have changed the ordinance to address performers’ concerns.

"You have to pay a permit fee for free speech, and that's wrong," he was quoted by the newspaper as saying..

The jurist says the lottery system for performers and sellers violates the 1st Amendment. He also strikes down a rule barring the use of musical instruments or amplified sound between 9 a.m. and sunset in designated areas.

A federal judge has blocked portions of a Los Angeles ordinance designed to regulate performers and vendors along the Venice Beach boardwalk.
U.S. District Judge Dean D. Pregerson issued the preliminary injunction last week, effectively stating that the city's permitting and lottery system for boardwalk performers and sellers violates the 1st Amendment.
The ruling involved a 2008 ordinance that required performers and vendors to seek permits to sing, dance and sell items along the boardwalk through a lottery system held between Memorial Day and Nov. 1.
In blocking the ordinance, Pregerson noted that the U.S. 9th Circuit Court of Appeals held that a similar permitting system in Seattle was unconstitutionally broad and only marginally regulated vendors, which the appeals court said could be achieved through "less intrusive means."
"There is no explanation as to why this system manages conflicting claims to limited space any more effectively than a simple first-come-first-served rule," Pregerson wrote in his 27-page ruling.
The judge also struck down a Los Angeles City Council rule barring the use of musical instruments or amplified sound between 9 a.m. and sunset in designated areas.
Street performer "Zuma Dogg", one of the plaintiffs in the challenge to the law, said Tuesday that the city was arrogant in refusing to tweak the ordinance to address their concerns."You have to pay a permit fee for free speech, and that's wrong," he said.

Dogg also took issue with confining amplified music to one condensed area.

The ordinance grew out of complaints by residents and business owners that unregulated vending affected the character, safety and economic vitality of the boardwalk.

        RON KAYE on Matt Dowd & Zuma Dogg VICTORY in FEDERAL COURT vs The City of Los Angeles (First Amendment Issue)

        You can laugh all you want at Matt Dowd and Zuma Dogg.

        You can look down your nose at them. You can let them get under your skin and be annoyed by them.

        But for the second time in recent years -- with Dowd as their lawyer -- they outsmarted all the lawyers and politicians in City Hall and won a federal court case against the City of Los Angeles.

        On Thursday, U.S. District Court Judge Dean Pregerson ruled that two key elements of the city's oft-rewritten ordinance intended to crack down on the vendors and street performers at Venice Beach is unconstitutional on their face (Venice Beach.rtf).

        A couple of years ago, Dowd won a $500,000 judgment against the city on behalf of himself and Michael Hunt over similar issues involving the city's efforts to control the antics that make Venice Beach what it is.

        It was this case that prompted Zuma Dogg and Dowd to become regulars in Public Comment at City Council meetings. The city keeps stalling on the humiliating act of paying them the money by appealing the case although a more recent Ninth Circuit Court of Appeals ruling in a Seattle case has weakened the city's claims.

        Today, a Federal Judge issued a STUNNING defeat to the City of Los Angeles as Zuma Dogg, Matt Dowd and nine other performers from Venice Beach Ocean Front Walk ("Venice Boardwalk") were issued an injunction, preventing the City from enforcing their amplified sound ban restrictions -- and blocking the lottery and permit system.

        In other words, Zuma Dogg and Matt Dowd can set up wherever they want without having to go through no fucking lottery system...we don't need no fucking permits...and we can blast our fucking music and anti-City Council candidate noise -- LOUDER THAN VAN HALEN...         Los Angeles City News for Thursday, October 21, 2010 - Oh no...EXPLOSIVE Memo on CURRENT CASE on L.A. City Corruption Emailed To ZD -- AND HE DON'T WANNA SEE IT! (Capishe!)

        Oh no...the problem with being back on LA City TV 35 as extreme gadfly, is the extreme info comes out of the marble city hall woodwork, into our email inbox. The stuff on LAHD corruption was BAD & UNCOMFORTABLE enough. 

        BUT THIS NEW MEMO THAT JUST CAME IN...is WAAAAAAAAAAY more than any single individual concerned citizen should be blasting.
